ENTRY PERIOD

Entries for the Huntington Beach Conference and Visitors Bureau (HBCVB) “See My HB” YouTube video Contest (the "Contest") will be accepted only from March 10, 2008 through April 30, 2008 ("Entry Period").

ELIGIBILITY

Contest is open only to residents of the City of Huntington Beach (zip codes 92646, 92647, 92648 or 92649) at the time of entry. Employees of the HBCVB, or its agents, affiliates or subsidiaries, and members of their immediate families and households are not eligible. If you are under 18 years of age, you must have your parent or guardian co-sign the entry form and any required releases. NO PURCHASE IS NECESSARY. This contest is VOID WHERE OR TO THE EXTENT PROHIBITED.

HOW TO ENTER

First, take a video showing your HB (Huntington Beach). Then during the Entry Period go to the HBCVB website at http://www.surfcityusa.com/seemyhb and fill out the official entry form with your required entry information (name, mailing address, email address, and phone number), and follow the instructions on the website to upload your video. Click on the Submit Entry button to complete the Entry process. All entries must include the title “See My HB” within the video.

VIDEO SUBMISSION DETAILS

Online Submission Instructions: Create your video page on YouTube.com. Then complete the Official "See My HB" Contest Entry Form online, including your video page url in the appropriate field. All videos submitted must meet YouTube.com’s requirements.

Your video ("Submissions") must be original, unpublished, and must not include any music, singing, other person’s photos, other person’s film or other images that are not originally taken or created by you and must not infringe upon any rights of any third party, including, but not limited to, copyright, trademark and right of privacy and publicity. By entering, you agree that the Submission is your original work created solely by you and that no other party has any right, title, claim or interest in the Submission.
There must not be any proprietary or logo clothing shown, no background containing artwork or recognizable commercial logos, or any inappropriate or offensive materials in the Submission. Entries that are incomplete, illegible, or corrupted are void and will not be accepted. All submissions must comply with and shall be governed by HBCVB’s Website Terms of Use and Privacy Policy, both of which are available at http://www.surfcityusa.com/legal/privacy.php.

All Submissions become the property of the HBCVB and may not be acknowledged and will not be returned. The HBCVB assumes no responsibility for loss or damage to Submissions. The HBCVB has the right to edit and use any and all Submissions including, but not limited to, entrant entry information for future advertising, publicity or promotion, or any other use in any medium now known or hereafter devised.

By entering your Submission to this Contest you are granting the HBCVB a worldwide, royalty-free, perpetual, non-exclusive unrestricted, irrevocable and fully sub-licensable right and license to broadcast, use, re-use, reproduce, modify, adapt, publish, translate, create derivative works of, distribute, re-distribute, sublicense (through multiple tiers), publicly perform and/or display your Submission (in whole or in part), and the images and likenesses that appear in your Submission (in whole or in part), and/or incorporate all or part of your Submission in other works, all in any form, format, media or technology now known or later developed. You will not be paid for your Submission or for granting the HBCVB any of these rights. The HBCVB is in no way obligated to use your Submission (and has no obligation to you or any other person or entity after your Submission is received), and you will not be given any credit if your Submission is used. Please also be aware that your Submission will not be received or held "in confidence" and your Submission does not create a confidential relationship or obligation of secrecy between you and the HBCVB. You are not an employee of the HBCVB. You may not resell, assign or transfer any of your rights under this Agreement.

Promptly upon the HBCVB’s request, you (or in case of entrants under 18 years of age, their parents or legal guardians) shall provide a signed written release from all persons who appear in your Submission, authorizing use of their respective likenesses in the Submission. The HBCVB may also require that you provide a signed written release from the copyright owner of any sculpture, artwork, music, dialogue, or other copyrighted material that appears in the Submission, authorizing its use in the Submission. Each of the foregoing releases shall be on a form prescribed by and in favor of the HBCVB and its licensees, affiliates, designees, successors, and assigns, and each of their respective officers, directors, employees and agents (collectively “HBCVB Affiliates”). Failure to provide either such release upon request may result in disqualification and selection of an alternate winner.

You agree to release, defend, indemnify, and hold harmless all HBCVB Affiliates from any and all third-party claims against any HBCVB Affiliate (and all related costs, expenses, losses, and damages suffered by them), arising out of your participation in this Contest or any Contest-related activities.

ONLINE POSTING OF ENTRY SUBMISSIONS FOR ENTERTAINMENT PURPOSES

During the Entry Period, through April 30, 2008, as eligible Submissions are received, the HBCVB in its sole discretion may elect to post certain Submissions, in whole or in part, for viewing on the Website. 

SELECTION OF THE FINALISTS

After the Entry Period closes, the HBCVB will choose two Video winners, one from each age category, 17 years of age and younger and 18 years of age and older. Four runner-ups (two from each age category) will also be awarded prizes. The judges will be looking for originality and creativity in showing your HB. The judges will be representatives of the HBCVB and may include committee members and board of directors. The decisions of the HBCVB are final and you agree to be bound by these decisions. 

WINNER NOTIFICATION/VERIFICATION

The winners will be notified by phone, email and/or mail within five (5) business days of April 30, 2008. If the winners cannot be reached from the information on the entry form, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, such potential winner will disqualified at the HBCVB’s sole discretion and alternate winner(s) will be selected. Any person attempting to defraud or tamper with the Contest, entry process or Website shall be automatically disqualified from the Contest. The HBCVB at its sole discretion, reserves the right to cancel, suspend or modify the Contest or any portion thereof. In case of a dispute over the identity of the entrant who submitted a winning Entry, the HBCVB reserves the right to deem the registered subscriber of the email account used to enter the Contest at the time of entry to be the entrant and winner. The account subscriber is deemed to be the natural person who is assigned an email address by the Internet access provider, on-line service provider, or other organization responsible for assigning email addresses. The HBCVB’s decisions are final and binding in all respects.

DISCLAIMERS

All entrants and Finalists assume all liability for any injury or damages caused or claimed to be caused by their participation in this Contest. All entrants and Finalists release the HBCVB Affiliates from any such liability.

HBCVB Affiliates assume no responsibility for any injury (including but not limited to any personal injury or death that may occur in connection with this Contest), damage or losses of any kind to any entrant, or to any entrant's or other person's computer, relating to or resulting from participating in this Contest, including downloading materials or software. HBCVB Affiliates are not responsible for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, incorrect, incomplete, inaccurate, garbled or delayed electronic communications, errors or failures of any kind, or by any human error which may occur in the processing of the entries in this event.

Sponsor reserves the right to terminate the entry period prior to its scheduled end date and to choose among entries received prior to the date of such termination. Sponsor reserves the right to review all entries on a rolling basis as they come in. In the event that Entry processing challenges or technical malfunctions occur, Sponsor reserves the right to change or discontinue the Entry submission procedures.

Entrants agree to be bound by these Official Rules and by the decisions of those voting whose decisions are final. Failure to comply with these rules may result in disqualification from this contest. The HBCVB reserves the right to permanently disqualify any person it believes has intentionally violated these rules.

 

 

“See My HB” Photo Contest Information

Enter your photos between March 10 and April 30, 2008 (Entry Period) in the “See My HB” photo contest! This is a photo contest sponsored by the Huntington Beach Conference and Visitors Bureau (“HBCVB”) to showcase Huntington Beach – Surf City USA®. The HBCVB may choose, in its sole discretion, to use any of the photos in one or more publications or on its website, to promote Huntington Beach and its surf, sand, sun and fun to visitors. Photos submitted during the Entry Period will be judged by the HBCVB based on creativity and originality in showing your HB. All photographers submitting photos in accordance with the Contest Rules will receive a Surf City USA® logoed sling pack to carry photography gear, or fun essentials to the beach (approximate retail value is $15.00; limit one sling pack per entrant).The top photos will be displayed at the Huntington Beach Central Library during National Tourism Week, May 10-18, 2008 and the winners of the two age categories, 17 years of age and younger and 18 years of age and older, will be honored at a reception held during National Tourism Week, May 10-18, 2008 in conjunction with Surf City Nights on Tuesday, May 13, 2008. Number of winners will depend on the quantity of eligible photos submitted.

Official Photo Contest Rules

  2. All photos must be in color and feature Huntington Beach. Photos must also be in good taste (i.e., not to be obscene, provocative, or otherwise objectionable) in the sole discretion of the HBCVB. All submissions must comply with and shall be governed by the HBCVB’s Website Terms of Use and Privacy Policy, both of which are available at www.surfcityusa.com.
  3. Each photograph, overall, must be your own original work. By entering the Contest, you represent, acknowledge and warrant that each photograph you submit is an original work created solely by you and that no other party has any right, title, claim or interest in the photograph.
  4. Entries must be received during the Entry Period to be eligible. There are no limits on the number of entries per person.
  5. Digital images must be submitted. Images must be at least 300 dpi in TIFF, JPEG or EPS and submitted via CD, DVD or Zip drive.
  6. Please include a print of each photo along with each digital image, with your name, address and phone number on a label on the back of each photo print. Do not write directly on the front of the photo print.
  7. All entries become the property of the HBCVB and may not be acknowledged and will not be returned. The HBCVB assumes no responsibility for loss or damage to submitted photographs.
  8. By entering the Contest, you agree that the HBCVB may copy, publicly display, sublicense, and make derivative works (e.g. crop) any of the photos you submit.  
  9. Photo credit will not be given unless the photo is featured on the photo contest page of the HBCVB website.
  10. Photos must not feature the intellectual property (e.g. trademarks or sculptures, paintings or other copyrighted works) of others. If they include such intellectual property (e.g. as an object in the background), they must not do so in a way that constitutes infringement or fraud or violates an artist’s visual arts rights or anyone’s rights of privacy or publicity.
  11. Each photo must be submitted with an official HBCVB entry form. Submit competed entries and photos during the Entry Period to the HBCVB at 301 Main Street, Suite 208, Huntington Beach, CA 92648-5171.
  12. Promptly upon the HBCVB’s request, you (or in case of entrants under 18 years of age, their parents or legal guardians) shall provide a signed written release from all persons who appear in the photograph(s) submitted, authorizing use of the photograph(s). The HBCVB may also require that you provide a signed written release from the copyright owner of any sculpture, artwork, or other copyrighted material that appears in the photograph(s), authorizing use of the photograph(s). Each of the foregoing releases shall be on a form prescribed by and in favor of the HBCVB and its licensees, employees, agents, affiliates, designees, successors, (“Authorized Persons”). Failure to provide either such release upon request may result in disqualification and selection of an alternate winner.
  13. By participating, all entrants grant to the Authorized Persons an exclusive, irrevocable perpetual,  royalty-free, fully sub-licensable world-wide license  to use the entries in publications, marketing and promotions in any and all media now or hereafter known without restriction, including commercially using and exploiting the entries to the fullest extent possible. Additionally, by participating, each entrant grants to the Authorized Persons the unrestricted right to use all statements made in connection with the Contest and pictures or likeness of Contest participants.
  14. By participating Contest entrants agree to be bound by these Official Rules and by the decisions made by the judges which shall be final.
  15. You agree to release, defend, indemnify, and hold harmless all Authorized Persons from any and all third-party claims against any Authorized Persons (and all related costs, expenses, losses, and damages suffered by them), arising out of your participation in the Contest or any Contest-related activities.
  16. The HBCVB is not responsible for any inaccurate or incorrect information. If the Contest is not able to run as planned, the HBCVB reserves the right to suspend or cancel the Contest without notice. If the HBCVB elects to cancel or terminate the Contest, the Authorized Persons will not retain any rights in the submitted photographs.
